1. Acceptance of Terms

By accessing and using the Smart Infotech website (smartinfotech.in) and engaging with our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all visitors, clients, and users of our website and services. Smart Infotech reserves the right to modify these terms at any time without prior notice.

All services are provided to Indian businesses, startups, and entrepreneurs in accordance with industry best practices and applicable Indian laws.

3. Project Engagement Process

Our standard project engagement process includes:

1. Initial Consultation: Understanding project requirements, goals, and timeline
2. Proposal & Agreement: Detailed project proposal with pricing and delivery timeline
3. Design Phase: Wireframes, UI mockups, and design approvals
4. Development: Coding, testing, and progress updates
5. Delivery & Launch: Final testing, deployment, and handover
6. Support: Post-launch support and maintenance (as per agreement)

4. Payment Terms

Payment terms for our services are as follows:

• Project Initiation: 50% advance payment required to begin work
• Milestone Payments: Payments due at agreed project milestones
• Final Payment: 50% balance payment before project delivery
• Currency: All prices are quoted in Indian Rupees (₹)
• Taxes: GST (18%) applicable as per Indian tax laws

Payments can be made via bank transfer, UPI, or other agreed payment methods. Late payments may incur additional charges.

5. Intellectual Property Rights

Upon full payment, the client receives full ownership rights to the delivered project, including:

• Source code and development files
• Design assets and documentation
• Content and media used in the project

Smart Infotech retains the right to showcase completed projects in our portfolio unless explicitly agreed otherwise in writing.

Third-party components, libraries, and frameworks remain under their respective licenses.

6. Client Responsibilities

Clients engaging our services agree to:

• Provide accurate project requirements and timely feedback
• Supply necessary content, materials, and access credentials
• Make payments as per agreed payment schedule
• Ensure they have rights to use any content provided
• Respond to communication within reasonable timeframes

7. Project Timeline & Delays

Standard delivery timelines depend on the selected package (Starter: 3-7 business days, Business: 5-12 business days, Premium: 10-15 business days). Delays may occur due to:

• Client feedback delays or scope changes
• Non-responsive communication
• Additional feature requests mid-project
• Technical dependencies or third-party services

Smart Infotech is not liable for delays caused by client-side factors. Timeline extensions may incur additional costs.

8. Revisions & Changes

Our standard project quotes include reasonable revisions as follows:

• Design Phase: Up to 2-3 revision rounds
• Post-Launch Revisions: Free minor revisions are included based on your plan (7 days for Starter, 14 days for Business, 30 days for Premium).

Major scope changes after project commencement will be quoted separately and may affect the delivery timeline.

9. Support & Maintenance

Post-launch support terms:

• Free Support Period: Aligned with your package's minor revision period (7, 14, or 30 days after launch).
• Paid Maintenance: Monthly maintenance and hosting renewal charges apply from the 2nd year.
• Scope: Bug fixes, security updates, and minor adjustments.

Maintenance plans do not cover new features, redesigns, or major structural changes.

10. Confidentiality

Smart Infotech treats all client information with strict confidentiality. We do not share client project details, business information, or personal data with third parties without explicit consent.

Client information is stored securely and used only for project-related communications and improvements.

11. Refund Policy

Our refund policy is as follows:

• Project advances are non-refundable once work has commenced
• Completed work that has been delivered is not eligible for refund
• Cancellation mid-project: Payment for completed work only
• Disputes will be handled on a case-by-case basis

We strive for 100% client satisfaction and encourage discussing concerns directly with us.

12. Warranty & Disclaimer

Smart Infotech provides a warranty period for delivered projects. However:

• Warranty covers bugs and technical issues in delivered functionality
• Warranty does not cover issues caused by client modifications
• Third-party services (payment gateways, hosting, etc.) carry their own warranties

We provide products "as is" without any guarantees beyond the scope of the agreed project requirements.

13. Limitation of Liability

Smart Infotech operates strictly as a website design and development service provider. We build websites according to the client's specific requirements, instructions, and provided materials. All websites go live only upon the client's explicit final review and acceptance.

By approving the final website launch, the client assumes full legal, operational, and business responsibility for the website and its contents. Smart Infotech's liability is strictly limited to the total project value paid for the technical development services. We are absolutely not responsible or liable for:

• Any legal issues, lawsuits, copyright infringements, or compliance violations arising from the website.
• Business/trade disputes between the client and their respective customers.
• Financial losses, loss of profits, or disruption of business operations.
• Data breaches or issues arising from third-party services (hosting, payment gateways, etc.).
• Indirect, incidental, or consequential damages of any kind.

14. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes arising from these terms shall be subject to the jurisdiction of Indian courts.

Smart Infotech is registered under the MSME scheme (Udyam Registration) and complies with all applicable Indian business and tax laws.
